About Federal Drug Crimes

The Drug Abuse, Prevention and Control Act of 1970 forms the basis of most drug control laws in the United States. The Act establishes five schedules (classes) of narcotics, along with the federal punishments for possessing, transporting or selling drugs. The federal government is particularly interested in cases that involve transporting across state or national borders, a special concern in states along the U.S. border, such as New York.

Drug trafficking and drug manufacturing are two examples of the types of activities that draw the attention of federal law enforcement authorities. The quantity and type of drugs being transported or manufactured have a dramatic impact on the potential penalties. For example, a first offense federal narcotics charge for trafficking five grams of pure methamphetamine will result in a minimum five year term in prison upon conviction. Should the amount of methamphetamine be at least 50 grams, the minimum prison term will be doubled.

Large-quantity drug trafficking is a federal drug crime that is also subject to the three-strike rule, which results in enhanced penalties for second and third offenders. Persons with two or more previous strikes on their criminal record will receive a life sentence if convicted. Mandatory life sentences are also possible in federal drug crimes charges for marijuana trafficking, in which death or serious injury resulted.
